What do marijuana and equal wages have in common? They are now both protected by law in CA.

Below are 3 new California employment laws for 2024 that business owners & employees should be aware of.

1) Discrimination against use of cannabis - AB2188 makes it unlawful for employers to discriminate against an employee for using cannabis off the job and away from the workplace. An exception exists for pre-employment drug screening or when employer-required drug screening tests find employees have nonpsychoactive cannabis metabolites in their hair, blood, or urine.

2) Protection of communication involving sexual assault, harassment, or discrimination - AB933 protects employees communications from civil action, including complaints of sexual harassment by an employee. The law also specifies the attorney's fees and damages available to a defendant in any defamation action brought against them for making that communication.

3) Protected employee wages - SB497 prohibits employers from paying wages that are less than the wages paid to an employee of the opposite sex for substantially similar work. In addition, employers may not prohibit their employees from disclosing their own wages, discussing the wages of others, or inquiring about another employee's wages.
